Backcountry Gallery Workshop Terms & Conditions
1. Agreement
By registering for a Backcountry Gallery workshop or tour, you agree to these Terms & Conditions. These terms apply to all participants.
2. Role of Backcountry Gallery
Backcountry Gallery LLC acts as an organizer and photography instructor only.
We do not own, operate, or control third-party services including, but not limited to:
- Transportation (airlines, boats, vehicles)
- Accommodations
- Guides or local operator
All such services are provided by independent third parties. By participating in a workshop, you acknowledge that Backcountry Gallery is not responsible for the actions, omissions, or performance of these third parties.
3. Itinerary Changes
Workshops take place in dynamic and often unpredictable environments. As such:
- Itineraries are subject to change at any time
- Wildlife sightings are not guaranteed
- Changes may occur due to weather, safety, logistics, or local conditions
Backcountry Gallery will make reasonable efforts to provide comparable experiences when changes occur. No refunds or credits will be issued due to itinerary changes or missed opportunities.
4. Payments & Cancellations
- Deposits and payments are subject to the cancellation terms provided at the time of booking
- Certain payments may be non-refundable due to supplier commitments
- Failure to make payments on time may result in cancellation of your booking
5. Travel Insurance
Travel insurance is strongly recommended for all workshops and tours.
For certain destinations, including the Galápagos, participants are required to carry:
- Medical insurance
- Emergency evacuation coverage
Participants are responsible for ensuring they meet any insurance requirements specific to their tour.
Backcountry Gallery is not responsible for any financial losses due to:
- Trip cancellations
- Delays
- Missed connections
- Medical issues
- Emergency evacuations
6. Additional Costs In the event of changes beyond our control, participants are responsible for any additional costs, including but not limited to:
- Hotels
- Transportation
- Meals
- Emergency arrangements
7. Late Arrivals and Missed Connections
Participants are responsible for arriving at the designated start location on time.
If you are delayed due to flight issues or other travel disruptions:
- We will make reasonable efforts to help you rejoin the workshop when possible
- However, in many cases, especially in remote locations, this may not be feasible
Any costs associated with catching up to the group, including but not limited to:
- Additional transportation
- Charter flights or boats
- Hotels or meals
are the sole responsibility of the participant.
In some itineraries, including vessel-based or remote-location tours, late arrival may result in complete inability to join the workshop.
No refunds or credits will be issued for missed portions of the workshop due to late arrival. Participants are responsible for building reasonable travel buffers to account for potential delays.
8. Participant Responsibilities
You agree to:
- Follow all instructions from workshop leaders and local guides
- Comply with all local laws and regulations
- Ensure you are physically capable of participating
- Carry proper travel documents (passport, visas, etc.)
Disruptive, unsafe, or illegal behavior may result in removal from the workshop without refund.
9. Physical Requirements and Fitness
Workshops may involve varying levels of physical activity depending on the destination and itinerary. This can include, but is not limited to:
- Walking on uneven terrain (sand, rocks, trails)
- Boarding and disembarking boats or vehicles
- Carrying camera gear for extended periods
- Early mornings, long days, and changing environmental conditions
By registering, you confirm that you are physically capable of participating in the workshop you have selected.
If you have any medical conditions, mobility limitations, or other concerns that may impact your ability to participate, you are responsible for evaluating your suitability and consulting with a medical professional if necessary.
Backcountry Gallery reserves the right to refuse participation or remove a participant from part or all of a workshop if, in the judgment of the workshop leader, their condition or behavior may:
- Compromise their own safety
- Impact the safety or experience of the group
- Prevent the workshop from operating as intended
No refunds or credits will be issued in such cases.
10. Instructor Substitution
In the unlikely event that the workshop leader is unable to attend, Backcountry Gallery reserves the right to substitute a qualified instructor or continue the workshop without refund.
11. Force Majeure
Backcountry Gallery is not liable for cancellations, delays, or changes caused by events beyond our control, including but not limited to:
- Weather or natural disasters
- Government actions or restrictions
- Transportation disruptions
- Health-related events
- Mechanical failures
12. Limitation of Liability
To the fullest extent permitted by law:
- Backcountry Gallery’s liability is limited to the amount paid for the workshop
- Backcountry Gallery is not liable for indirect, incidental, or consequential damages
13. Media Release
Unless otherwise requested in writing, you grant Backcountry Gallery permission to use photographs or video taken during the workshop for promotional purposes.
14. Governing Law
These Terms & Conditions are governed by the laws of the State of Ohio.
